This Privacy Policy describes how Black Diamond Funding Ventures LLC, doing business as Black Diamond Claims Solutions ("Black Diamond," "we," "us," or "our"), collects, uses, and shares information when you use this Additional Living Expenses (ALE) / Loss of Use coverage tool (the "Tool"). By using the Tool, you agree to this Policy. If you do not agree, please do not use the Tool.
1. Information we collect
Information you provide. The contact details you submit — your name, email address, and, optionally, your phone number — and the insurance policy document you upload to run a search.
Information collected automatically. When you use the Tool, our hosting systems may automatically log limited technical information such as your IP address, browser type, and time of access, for security, troubleshooting, and to operate the Tool. The Tool does not use advertising cookies or third-party ad trackers.
2. How we handle your uploaded policy
Your uploaded policy is used only to perform the search you request. It is processed in temporary memory to read the document and is not stored on our servers and is not published anywhere. To read the document, its contents are transmitted to our AI processing provider solely to perform the extraction; that provider does not use your document to train its models.
3. How we use your information
We use your information to: (a) locate and display the ALE / Loss of Use coverage in your policy and prepare a report of what your policy states; (b) with your consent, contact you by phone, text, or email about our ALE and Temporary Housing services; (c) operate, maintain, secure, and improve the Tool; and (d) comply with law and enforce our terms. A copy of the report, together with your contact details, is sent to Black Diamond so we can follow up with you.
4. What this Tool does not do
The Tool only extracts and displays what your own policy document states. It does not interpret your policy or provide insurance, claims, or legal advice.
5. Phone call consent
Providing your phone number is optional. If you provide it and check the phone-consent box, you consent to receive phone calls from Black Diamond about our Additional Living Expenses (ALE) services. We do not send text messages through this Tool. Consent to receive calls is not a condition of any service, and you can opt out at any time by telling us during a call or by emailing info@blackdiamondservices.com.
6. How we share information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only with: (a) service providers who process it on our behalf to operate the Tool (for example, our AI processing provider, email delivery provider, and hosting provider); (b) authorities or others when required by law or to protect rights, safety, and property; and (c) a successor in connection with a merger, acquisition, or sale of assets.
7. Data retention
Contact details and reports stored on the Tool's system are automatically deleted after a short retention period (by default, 7 days). Copies delivered to us by email are retained in accordance with our internal business and recordkeeping practices. You may request deletion as described below.
8. Your rights and choices
You may opt out of marketing contact at any time (reply STOP to texts, unsubscribe from emails, or ask us to stop). You may request to access, correct, or delete the personal information you provided by emailing info@blackdiamondservices.com. We will respond consistent with applicable law.
9. California privacy rights
If you are a California resident, the CCPA/CPRA gives you rights to know the categories and specific pieces of personal information we collect, to request deletion or correction, and to opt out of the "sale" or "sharing" of personal information. We do not sell or share your personal information as those terms are defined under California law. We will not discriminate against you for exercising your rights. 10. Other state privacy rights
Residents of certain other states may have similar rights to access, correct, delete, or obtain a copy of their personal information, and to opt out of targeted advertising or sale. To exercise any such rights, contact us at the email above.
11. Children's privacy
The Tool is intended for adults (18+) and is not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.
12. Data security
We use reasonable administrative and technical measures to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
13. Third-party links and services
The Tool may reference or rely on third-party services. Their handling of your information is governed by their own privacy policies, and we are not responsible for their practices.
14. Changes to this Policy
We may update this Policy from time to time. Changes are effective when posted, and the "Effective date" above will be updated. Your continued use of the Tool after changes take effect constitutes acceptance.
